Who are we?

The National Distribution Office (ENDR) is a private non-profit association, established in accordance with articles 4 to 7 of Ordinance No. 41/2025 issued by the Betting and Prizes Secretariat of the Brazilian Ministry of Finance (SPA/MF). Our mission is to organize, systematize and optimize legal contributions to private beneficiaries established in Law No. 13,756/2018.

By centralizing the distribution process, the ENDR allows its associated operators to transfer the private portion of the contribution in a simplified manner, making a single monthly transfer to the Office. The amounts are then duly apportioned and distributed to the legal beneficiaries, ensuring efficiency and compliance.

Distribution of Funds

In addition to ensuring the correct allocation of funds, the ENDR is responsible for analyzing contracts, regulations and arrangements for sports competitions, enabling the accurate distribution of private contributions.

Audit and Transparency

To reinforce the transparency and integrity of the process, ENDR carries out periodic audits of the transfers, reporting directly to the Ministry of Finance.

Legal basis and regulatory developments

Law 13.756/2018

The regulation of sports betting in Brazil has evolved significantly since the enactment of Law 13.756/2018, which legalized fixed-odds betting and defined guidelines for the social destination of the funds collected.

Article 30, §1-A

Article 30, §1º-A of the law establishes that 12% of gross gaming revenue (GGR) must be earmarked for social functions, covering both public and private destinations, with a focus on supporting national sport, social entities and government bodies linked to the sector.

SPA/MF Ordinance No. 41/2025

The regulation of private transfers was formalized in January 2025, with the publication of SPA/MF Ordinance No. 41/2025. This rule disciplines the private social allocations provided for in the legislation, benefiting athletes, clubs, federations and social organizations, bringing greater clarity and legal certainty to the process.

SPA/MF Ordinance No. 1.212/2024

Almost six years later, in July 2024, the Ministry of Finance’s Prize and Betting Secretariat (SPA/MF) published Ordinance SPA/MF No. 1,212/2024, detailing the financial and documentary procedures for the transfer of these funds, with an emphasis on the public contributions described in Art. 30, §1-A. Beneficiaries include state and federal sports departments, the Ministry of Tourism and other government entities.

FAQ

What is the National Distribution Office (ENDR)?

ENDR is a private non-profit association created to operationalize the contributions levied on GGR (gross gaming revenue) destined for the entities of the National Sports System, Sports Committees and Confederations and Civil Society Entities, in light of Art. 30, § 1-A, lines “a” to “g” and “j”, and item VII, of Law No. 13,756/2018 and Arts. 4, 5, 6 and 7 of SPA/MF Ordinance No. 41/2025.

Membership of the ENDR is optional. Operators benefit from the centralization and operationalization of these transfers, through the ENDR’s Transfer and Sports Departments. The operator’s choice of membership is passed on to the Prizes and Betting Secretariat.

The amount of the membership fee is still being determined. In the first year of operation, a transitional budget structure will be adopted. This structure will meet the regulatory requirements set out in Ordinance 41/2025.

The ENDR is a non-profit association – in other words, the money raised will be used exclusively to fund its operation, which means that the final amount will depend on the number of member companies.

Through a proprietary financial solution, as well as contact with sports entities to align tournament rules and transfers to teams and athletes, ENDR will consolidate operators’ contributions and make the proportional transfer as described in Law No. 13,756/2018, in the following proportion:

  • 12% of the GGR will be earmarked for legal purposes;
  • Of this 12%, 63.5% is earmarked for public functions such as education, social security and health.
    • This funding is not carried out by the ENDR, but must be allocated by the operator by issuing a Federal Tax Payment Document (DARF).
  • The remaining 36.5% will be distributed by the ENDR as follows:
    • Sport (36%)
      • Entities of the National Sports System + Athletes (7.30%)
      • Brazilian Olympic Committee (2.2%)
      • Brazilian Paralympic Committee (1.3%)
      • Brazilian Confederation of Clubs (0.7%)
      • Brazilian School Sports Confederation (0.5%)
      • Brazilian University Sports Confederation (0.5%)
      • Brazilian Confederation of Master Sports (0.3%)
      • Brazilian Committee of Paralympic Clubs (0.3%)
    • Civil Society Entities (0.5%)
      • Fenapaes (0.2%)
      • Fenapestalozzi (0.2%)
      • Red Cross (0.1%)

The Office adopts information security policies, data segregation, encryption systems and annual independent audits, under the terms of Articles 5 and 6 of SPA/MF Ordinance 41/2025. In addition, the transfer technology solution and its provider adhere to strict data protection and compliance standards.

The ENDR must start operating in pilot mode by July 10, 2025, taking into account the extension provided for in the rule, according to Art. 7, § 1 of SPA/MF Ordinance No. 41/2025.

Under the terms of Article 5 of SPA/MF Ordinance 41/2025, the ENDR is subject to an annual independent external audit and is subject to inspection of the amounts received and transfers by the Ministry of Finance’s Prize and Betting Secretariat. In addition, each Member Operator receives a monthly statement showing the destination of their transfer.

In addition, the ENDR works on the principle of data segregation: the statement of an operator’s transactions is sent exclusively to the operator and to the SPA/MF.

To join the National Distribution Office, the Operator must send the following documents to rateios@endr.com.br:

  • The company’s CNPJ card;
  • Current Articles of Association;
  • Identification documents of the legal representatives;
  • Completed membership form, according to the model provided by ENDR; and
  • Authorization order issued by SPA/MF.

The National Distribution Office (ENDR) acts as a focal point for clarifying doubts and coordinating negotiations between the associated betting operators, the beneficiaries of the social allocations and the Ministry of Finance’s Prize and Betting Secretariat. This facilitates the standardization of procedures, ensures regulatory compliance and makes the management of transfers more efficient.
